PVR application news

Gaillardia Summers Kiss

The EU Plant Variety Rights application for Gaillardia Summers Kiss has now been filed.

The CPVO file number is 20061179. The application date is 23 May 2006.

Under EU law, a pending application for PVR affords the same protection to the breeder as if it had been granted. Therefore, we wish to remind growers that propagation and sale without a licence is prohibited.

Summers Kiss is a splendid, free-flowering perennial that flowers in the first year from cuttings. It makes an excellent impulse plant and can be used in containers or in the border. Full details can be found here.

We now have test plants of Gaillardia Summers Kiss available for growers who wish to conduct production trials for this variety. If you are interested in receiving test plants, please contact us.

Nemesia Amelie/FLEURAME

Martine Tellwright, breeder of Nemesia Amelie, has been granted EU Plant Variety Rights for this variety.

The variety is registered under the denomination FLEURAME. The grant number is EU17384. The CPVO file number is 20040636.

The application was handled by Plants For Europe Limited, who also act as the breeder’s agent for the whole world except North America.

Our friends at Lyndale Intellectual Property have filed PVR applications in New Zealand for two varieties in the PFE portfolio:

  • Ajuga BINBLASCA (Black Scallop) – file number HOM220
  • Lysimachia WALGOLDALEX (Golden Alexander) – file number HOM221

This is a continuing part of our efforts to ensure that PFE varieties are protected in all countries where there is a significant market for that variety. Growers in New Zealand interested in either of these varieties should contact Robert Bett at Lyndale.

Nemesia Celine

An application for Plant Variety Rights in the variety Nemesia Celine has been filed with the CPVO on behalf of the breeder, Martine Tellwright. The details of the application are as follows:

Provisional designation: Nemesia foetens Vent. FLEURCEL
Breeder’s reference: Celine
File number of the application: 20060810
Date of filing: 29 March 2006

European law states that the filing of an application grants the same level of protection as if the application had been successful and the right granted. Therefore, it goes without saying that propagation for sale or other distribution without a licence is illegal.

Our friends at Plant Management Australia, who act as local territory agents for Ajuga Black Scallop, have filed the Part 1 application for Plant Breeder’s Rights for Ajuga Black Scallop (BINBLASCA). The file number is 2006/030.
